The Data Controller under the General Data Protection Regulation, hereafter referred to as ‘Alfen’.
A. PERSONAL DATA
1. Introduction
Alfen respects the privacy of its clients, the users of its products and the visitors to its website. Alfen processes all personal data in compliance with the applicable legislation, in particular the "GDPR" (General Data Protection Regulation).
By means of this privacy policy Alfen wishes to inform you how Alfen deals with your personal data. 2. Data Controller
This privacy policy applies to the processing of personal data by Alfen B.V. and its sister companies Alfen ICU B.V., Alfen Project B.V. and Alfen BVBA, hereafter jointly referred to as "Alfen". In principle, Alfen B.V. is responsible for the processing, unless another company is the recipient of the personal data, in which case this company is responsible.

Alfen has not deployed a data protection officer.
3. Collection
Alfen receives your personal data in case you have entered you details by form on our website, in case you entered details through a questionnaire sent to you by email, in case you place an order on our website, in case you are the recipient of services from Alfen, in case you use certain Alfen products and/or in case you send us emails, there is telephone correspondence between you and Alfen or you have contacted Alfen employees otherwise, for instance at conventions or events.
4. Personal data
Fundamentally, you do not need to provide Alfen with your personal data in order to use the majority of Alfen's website.
Alfen can collect and process the following categories of personal data for the under "5. Pursposes" listed purposes:
a. Name and address details;
b. Contact details, such as your email address or telephone number;
c. The company you are active at;
d. Your CV and other details provided by you in case you have applied for a job via the website.
Remaining specific data provided this has been collected through a questionnaire filled in by you. In case you have filled in certain forms on our website, you could have also provided additional data. This also applies in case you have contacted Alfen otherwise, for instance by means of email, telephone, at conventions or other events.
Furthermore, Alfen can collect and process data received from the website or from the device you used to visit the website. This can include:

5. Legal grounds and purposes
Above-named personal data can be processes based on the following grounds:
a. You have granted permission to do so (article 6 section 1 subsection a GDPR);
b. Processing is necessary for realising an agreement in which you are one of the relevant parties (article 6 section 1 subsection b GDPR); or
c. Processing is necessary to comply with legal requirements that Alfen is subjected to (article 6 section 1 subsection c GDPR).
Alfen collects your data listed under "4. Personal data", for the purpose of providing better service. More specifically, the personal data is collected for the following purposes:
a. To respond to your questions about our products or services and in order to provide you with information regarding our products or services;
b. To provide products or services requested by you;
c. To verify your identity and financial data with respect to the delivery of our products and services.
d. To improve our products and services;
e. To analyse and follow up on complaints about our products or services.
f. To comply with legal requirements and requirements arising from "compliance";
g. To send you emails concerning special offers for our product and services that could be relevant to you.
h. To assess if you are suitable for employment at Alfen, in case of a job application via the website.
6. Recipients of your personal data
Alfen can share your personal data with:
a. Third-party companies, as described in section "2. Data Controller";
b. with respect to personal data which you have requested us to share by making connections between accounts;
c. Alfen product sellers, in case you as a private individual wish to buy Alfen products via the Alfen website.
Alfen could share personal data with third parties supporting Alfen in providing and facilitating their products and services, such as the website host, the questionnaire host, the party analysing data and the providers of marketing support and customer service. They are granted access to your personal data only if it is strictly necessary for their activities. It is strictly and explicitly forbidden for all third parties that Alfen shares your personal data with to use it for purposes other than those stipulated in the agreement between Alfen and these third parties.
Alfen shall not sell your personal data to third parties or otherwise disclose it for remuneration.
In case certain Alfen group activities are sold or transferred to other companies, the possibility exists that your personal data is disclosed to the advisor of the potential recipient. In principle, Alfen will not disclose your personal data to countries outside of the European Economic Area. Under no circumstance will Alfen disclose your personal data to third parties located in countries outside of the European Economic Area. Yet, the actual locations where specific data is saved is not always verifiable (think of back-up servers). Under these circumstances however, Alfen will continue to protect your personal data by making processing agreements with third parties processing your personal data, in which obligations arising from the GDPR are also imposed on these third parties.

You have the right of insight or a copy of your personal data and/or you can have your data changed if it is incorrect or incomplete. You have the right to constrain your personal data or file a complaint regarding the processing of your personal data. You have the right to request the disposal of your personal data. In making a request, Alfen could ask you to reveal your identity, in order to determine whether your request is legitimate.
Alfen can reject your request for insight in case this leads to the violation of privacy rights of other persons, the disclosure of company secrets or to the benefit of protecting intellectual property. In case your details are needed to comply with an agreement or legal requirement, the possibility exists that your data cannot (yet) be deleted.
You have the right to file a complaint to the Personal Data Authority.
8. Retention period
Alfen retains your personal data for as long as is strictly necessary to correctly carry out its intended purpose. In case Alfen has collected your data as part of an agreement, your personal data will be retained for as long as is strictly needed to carry out the objective of this agreement. In case data has been collected with your consent, your personal data will be retained until you revoke your consent or until the personal data is no longer strictly necessary for achieving the intended purpose.
Legal requirements may dictate that your personal data must be retained after it has served its intended purpose. In this case we are bound to do so.
9. Guarantee
How we deal with your personal data is paramount to Alfen. Alfen cannot guarantee that the measures implemented by Alfen are impossible to bypass, since the internet is an open system. However, Alfen takes all appropriate technical and organisational measures to protect your personal data from loss, alteration or unauthorised access.
Access rights regarding your personal data are limited by Alfen. Moreover, only the personal data that is strictly necessary to achieve the intended purpose will be used. Persons who have access to your personal details are correctly informed about its confidentiality and are instructed to handle it with the utmost care. They are also bound to a non-disclosure agreement to guarantee the integrity and confidentiality of your data.
10. Alterations
Alfen reserves the right to make amendments to this privacy policy in case something changes in the personal data processing policy Alfen sets forth. This amended version automatically and immediately takes effect upon completion and therefore replaces the preceding version. Alfen advises to check the privacy policy regularly, since amendments and alterations can be implemented.
